Directions for Filing an Ohio Prevailing Wage Complaint

A complaint may be filed by the following parties:
  1. An employee who is working or has worked on the project.
  2. Any person or contractor who had submitted a bid for the purpose of securing the award of a contract for construction of the public improvement.
  3. Any person or contractor acting as a subcontractor for the party mentioned in #2.
  4. Any bona fide organization of labor which has as members or is authorized to represent employees of a person mentioned in #2 or #3 and which exists, in whole or in part, for the purpose of negotiating with employers concerning the wages, hours, or terms and conditions of employment of employees.
  5. Any association having as members any of the persons mentioned in #2 or #3 of this section.
  6. The public authority who has contracted parties for the construction of the public improvement.

Do not complete this form if one of the following applies:
  1. The project has been completed for two (2) years.
  2. You already have a judgement involving the same wage claim.
  3. The contractor has filed for bankruptcy.

Filing More Than One Complaint:
  1. You must use a separate complaint form for filing against each contractor and/or project.
  2. Each claimant intending to file against a contractor and/or project must use a separate complaint form.

Completing The Prevailing Wage Complaint Form:

Read all questions on the wage claim form carefully before answering. Please fill out your claim completely and as accurately as possible.

Provide the contractor's name, name of business, correct address, county, and telephone number.

If you are unsure of the information that is being requested, please mark the fields "NA". Also, you must give a summary of your purpose for filing the complaint in the "Comments" section. Failure to do so will prohibit the submission of the complaint.

To help prove your claim, please provide copies of any documentation you have available. For example, pay stubs or a personal record of hours worked on the project.

Be certain that your name, address, email address, and telephone number are correct. If you do not have a telephone number, please supply this Division with a telephone number where we can reach you. If your address or telephone number changes, it is your responsibility to notify us immediately or your claim could be closed.
